10 Suits Seeking Buhari’s Disqualification To Be Decided On March 24

ABUJA – ‎The Presidential candidate of the All Progressives Congress, APC, Major-General Mohammadu Buhari, rtd, yesterday, maintained that no court has the power to stop the Independent National Electoral Commission, ‎INEC, from conducting presidential election on March 28.
Buhari stated this on a day that 10 separate suits that are seeking to disqualify him from participating in the scheduled presidential election came up before Justice Ademola Adeniyi of the Federal ‎High Court sitting in Abuja.

Addressing the high court yesterday through his team of lawyers comprising five Senior advocates of Nigeria, SANs, led by Chief Wole Olanipekun, the APC presidential flag-bearer, insisted that all the suits were targeted at stopping the presidential election.

He urged the court not to allow itself to be ‎used for that purpose, stressing that “section 87(11) of the Electoral Act, as amended, cautions courts not to do anything or take any action or issue any injunction that will stop the holding of primary or general election”.

He said: “My lord, it appears that this matter ‎is targeted at stopping the presidential election, if that is the case my lord. This court should not be used for that purpose”.

Earlier, Chief Mike Ozehkome, SAN, who is representing one of the plaintiffs challenging the competence of Buhari to contest the election, Mr. Chukwunweike Okafor, prayed the court to expedite hearing on the matter to enable it to determine the fate of Buhari before the presidential election.
He drew the attention of the court to the fact that it is barely nine days to the election. “We have a plethora of court processes that are already filed in this matter.

“The position of the law as adumbrated in a legion of cases, starting from the apex court, is that in an action commenced by Originating Summons such as ours, which is meant ‎to construct certain section of the Electoral Act and the constitution, the Originating Summons should be taken together and cumulatively with any process challenging the jurisdiction of this court to hear this suit.

‎”This matter should be expeditiously heard and determined before March 28 so that we don’t have the situation of having a pretender put on the throne”, Ozehkome asserted.

His submission infuriated Buhari’s lead counsel, Olanipekun, SAN, who contended that the matter was originally adjourned for the court to hear his client’s application challenging the manner the suit was served on him.

He said that the suits were pre-election‎ matters that could be heard and determined even after the presidential poll.

‎”There is no law, authority or decision that compels any court to give judgment in a pre-election matter before the election itself. The matter is not time bound, it is not like election petition.

“My lord the Supreme Court has held that pre-election matter re‎mains a live issue before or after election. What we are saying is that the court is not encouraged to rush pre-election matters because it is said that justice rushed is justice crushed.

“That was the decision in Ibe vs Onuora, 1998, 7NWLR, at part 558 and page 363. Moreover, section 158(c) of the Evidence Act enjoins your lordship to take judicial notice of newspaper publications”.

He drew the attention of the court to a newspaper publication ‎on February 4, 2015, where the Chief Justice of Nigeria, CJN, while swearing-in election tribunal judges, warned that “judges should not allow themselves to be used to truncate our democracy again”.

Olanipekun said: “The ‘again’ as used by the CJN, means that such thing had happened before, and that is the June 12 debacle. We have a motion which is challenging service, that is the very foundation of the action and goes to the root of your lordship’s jurisdiction”.

On its part, the APC, through its lawyer, Prince Lateef Fagbemi, SAN, aligned with Buhari and argued that the issue about the legality of the service of the court process on the defendants ‎must be determined first.

Likewise, INEC lawyer Mr. Hassan Liman, SAN, opposed the consolidation of the originating summons and the preliminary objections for hearing, even as he urged the court to direct all the parties to file their pleadings.

INEC ‎told the court that it had already entered a preliminary objection against the suit.
Responding to the argument of all the defendants, the plaintiff’s counsel, Ozehkome, relied on Order 29 Rules (1- 5) of the Federal High Court Civil Procedure Rules, and insisted that there was need to speed up hearing on the matter.

“Our application has to do with the disqualification of the 1st defendant. It is better to do it timeously before the election. My lord there are more than 16 presidential candidates participating in the election. Does it mean that disqualifying one of them will amount to truncating the election? That is over exaggeration my lord”, Ozehkome posited.
Meantime, Justice Adeniyi yesterday adjourned the matter till Tuesday next week for ruling.

‎Both Buhari and the APC had asked Justice Adeniyi to set aside the order he made on February 2, which directed that the court processes should be served on them by publishing same in three national dailies.

The court had also granted an order of abridgment of time within which the defendants must respond to the suits.

‎However, both Buhari and his party, contended that there was no urgency in the matter to warrant the court to hear the suits in a hurry.

Basically, ‎the plaintiffs are among other things, praying the court ‎for a declaration that the 1st defendant, Buhari, is not eligible to participate in the 2015 presidential election for failure to comply with the terms for submission of list of candidate and affidavit of personal particulars of persons seeking election to the office of President.

They are seeking similar reliefs, including, “A declaration that by the combined provisions of sections 31(1) (2) and (3) of the 2010 Electoral Act (as amended) and INEC Form CF 001, the 1st defendant is mandatorily obliged by law to comply strictly with the provisions laid down under the Electoral Act (as amended) and INEC Form CF 001 as it relates to attaching evidence of the 1st defendant’s birth certificate and evidence of his educational qualifications as required under INEC Form C.F 001.

“A declaration that the Curriculum Vitae and Voters Registration card attached by the 1st defendant in his INEC ‎Form C.F 001 and submitted to the 2nd defendant, INEC, as a Presidential Candidate in 2015 general election is not in conformity with the form prescribed by the Electoral Act/INEC Form C.F. 001 and is manifestly in contravention of the said Act/INEC Form C.F. 001 and therefore null and void”.

Specifically, one of them, Mr. Max Ozoaka is seeking for an order of court declaring as invalid the INEC Form C.F. 001 as filled and submitted by Buhari “as being inchoate and manifestly in contravention of the provisions of the Electoral Act”.

He argued that Buhari’s failure/ refusal to attach evidence of his birth certificate and educational qualifications, “which are conditions inherent/ precedent ‎as prescribed in the form”, was in breach of relevant laws in Nigeria pertaining to presidential election.

He prayed the court not to only declare the Form CF. 001 that was submitted to INEC by Buhari ‎for the 2015 presidential election as incompetent, but to also declare that the Voters Card that was attached to the form was false on the ground that as at when the voters card was issued, the 1st defendant was not a “public servant” as he allegedly stated.
“An order ‎declaring the said voters card as void for containing false information about the identity/occupation of the 1st defendant.

“An order disqualifying the 1st defendant from contesting and/or participating in the Presidential election fixed for February 14, 2015 or any date that the 2nd defendant may fix on the ground that the information contained in the 1stbdefendant’s INEC Form CF. 001 is false.

“An order restraining the 2nd defendant from permitting the 1st defendant from participating in the Presidential election fixed for February 14, 2015 or any other date that the 2nd defendant may fix”.
Ozoaka posed eight questions for the determination of the court, among which included; “Whether having regards to the provision of section 31(cool of the Electoral Act, as amended, and INEC Form C.F. 001 filed by the 1st defendant and the fact that the 1st defendant stated therein that he is a member of the All Progressives Congress Party (APCP), whether the 1st defendant is a member of a political party recognised by law in Nigeria which will enable him to participate in the 2015 presidential election.
“Whether or not the identification/voters card submitted by the 1st defendant to the 2nd defendant wherein the 1st defendant is shown to be a “public servant” as at January 22, 2011, is true or false?
“Whether or not the document purported to be the Statement of Result/Result Sheet of the 1st defendant’s Secondary School Certificate Examination (SSCE) provided by the Government College Katsina and the Katsina State Ministry of Education and referred to at the Press Conference of the 1st defendant held on January 21, 2015, is truly and correctly that of the 1st defendant, having regard to the name of the 1st defendant as stated in his affidavit submitted to the 2nd defendant and the name in the said document”.
In a 30 paragraphed affidavit that was deposed to by the plaintiff, he averred that the 1st defendant retired from Nigerian Army on August 1985 after he was removed from office as military Head of State pursuant to a military coup.
“That the 1st defendant left the Petroleum (Special) Trust Fund as its Executive Chairman in May 1999. That I know for a fact that th‎e 1st defendant stated on oath that his certificates evidencing his educational qualifications are in the possession of the Nigerian Army.
“That I know for a fact that at a press conference held on January 20, 2015, the Nigerian ‎Army spokesman, Brigadier General Oluseye Lajide stated that the Nigerian Army is not in possession of the 1st defendant’s certificates evidencing his educational qualifications”.

He told the court that a Statement of Result that was eventually made available to the press by the 1st defendant through ‎Government College Katsina and a University of Cambridge West Africa School Certificate Result sheet, had the name of one “Mohammed Buhari”, “and not the name of the 1st defendant as copi‎ously appeared and used in the 1st defendant’s voters card. Affidavit and other documents attached to his INEC Form C.F. 001″.

Elections 2015: DPP Adopts Buhari

As the 2015 general elections approaches, political alignments and re-alignments seem to be the order of the day.
Leadership reports that the Democratic People’s Party (DPP) has adopted the presidential candidate of the All Progressive Congress (APC), General Muhammadu Buhari (rtd), as its presidential candidate for the 2015 general elections.
The acting National Chairman of DPP, Chief Garshan Benson announced the adoption of Buhari yesterday, after the party held its National Executive Committee (NEC) meeting in Abuja.
He explained that the adoption came through a motion moved by Mr. Danila Asuno, Chairman of the party in Edo State, and was seconded by Hon. Chima Nsirim, his counterpart in Rivers State and there was no opposition to it.
According to him, the NEC took the decision after reviewing the state of the nation, and baring in mind that the party do not have a presidential candidate for the 2015 general election.
Benson said:“We commend President Goodluck Jonathan for the much he has done for this country, but we believe that much more need to be done. It is also our view that PDP as a party in power for 16 years has ran out of ideas on how to manage the current challenges facing the country, hence a serious need for change of leadership.
“We hereby urge all our members all over the country to support and vote for General Muhammadu Buhari the presidential candidate of the APC 2015 presidential election,”  he concluded.
In a related development, the Independent Democrats and United Progressives Party have denied pledging support for Buhari in the forthcoming elections.
Meanwhile, the chairman of the Senate Committee on the Federal Capital Territory, Senator Smart Adeyemi, has explained two fundamental errors that could cause Buhari, to lose the presidential election.

Ambode And Agbaje Fighting For Igbo Votes.

Popularly referred to as the economic hub of the country, Lagos state has a population of 20 million people, making the sprawling city bigger than the developed cities of London, Buenos Aires and even Beijing.
In Lagos, there are 20,000 people per square kilometer while it has been estimated that some 3,000 people from other states of the country flood the state every day without leaving.
But perhaps the most impressive project for the Lagos of tomorrow is no other than the Eko Atlantic, a pioneering residential and business development located on the Victoria Island, along its upmarket Bar Beach coastline.
The ambitious project is being built on three and half square miles of land reclaimed from the Atlantic Ocean and is expected to provide accommodation for 250,000 people and employment opportunities for a further 150,000.
Aside this, the United Nations has conferred a megacity status on cities with a population of 10 million and above.
Interestingly, Lagos belongs to this category.
But a megacity requires a stronger financial base. The sheer size of funding required in sustaining a megacity is beyond what a government could provide on its own.
Progressive increase
This is where creativity comes in as other sources of revenue must be sought in order to finance government’s expenditure.
These other sources include borrowing, both internally and externally, grants, bonds, Public Private Partnerships and others. In Lagos State, for instance, despite the progressive increase in the monthly Internally Generated Revenue, (IGR), of the state from a meagre N500 million in 1999 to about N20 billion presently, the state government still has to invent options to fund its projects.
Perhaps, this informed the need for the scramble for Lagos by political actors across party divides.
With elections around the corner, the battle for the governorship position in Lagos State promises to be fierce as the ruling All Progressives Congress, APC, and Peoples Democratic Party, PDP have begun flexing their political muscles ahead of the April 11, 2015 election.
For the ruling party, the polls will be keenly contested.
Already, the is cast between the APC candidate, Mr Akinwumi Ambode and his PDP counterpart, Mr Jimi Agbaje.
Interestingly, the two contenders have gone round the nooks and crannies of the state to tell the people of the state their plans, visions and missions for the people of the state.
The clamour for votes has reached a height that not only have appealed to indigenes of the state but have gone a step further to seek the support of non-indigenes resident in the state.
Like the scramble for the African continent by European powers in the 18th and 19th Century, which eventually led to the partitioning of Africa, Agbaje and Ambode are making efforts to transverse the state to get support from non-indigenes.
It is imperative to note that non-indigenes in Lagos State have become a major factor in Lagos politics and as such, their votes are important to determine the outcome of elections in the state.
Daily influx
It would be apt to state here that Lagos has become home to many people as there are daily influx of people from all parts of the country.
Expectedly, non-indigenes make up bulk of the population of the state but not only northerners, easterners and those from the South-South are non-indigenes resident in Lagos.
There are also a large chunk of people from the South-west, who are resident in Lagos.
Interestingly also, the non-indigenes have, over the years, occupied political offices in the state. With the governorship elections around the corner, pundits posit that the roles of non-indigenes cannot be overlooked as they remain a major factor that will determine the outcome of the elections and also, who emerges next governor of the state. In 2005/2006, when the population census was taken, the government of Bola Tinubu did a census alongside the Federal Government and came out with the figure that Igbo have 43 per cent population in Lagos State. As a result of the insurgency in the north today, the population has increased.
The APC and PDP have realised the importance of the non-indigenes, hence the parties decided to concede some elective positions to them.
Presently, the non-indigenes resident have continued to endorse Ambode and Agbaje, promising to throw their weights behind the duo owing to their voting population in the state. However, the two candidates have found the non-indigenes from the South-East geopolitical zone as the beautiful bride.
Overtures by the APC and PDP have been made to leaderships of market associations and political leaders from the region resident in Lagos to support their cause. Also, promises of democracy dividends have been made to the Igbo resident in Lagos by both Agbaje and Ambode.
It is important to state here that in the 16 year rule of the present administration, those from the South-East have benefited from the political appointments in the APC-controlled government having served in the executive cabinet of the state state.
The PDP governorship candidate, on the other hand, has promised the Igbos of not only political appointments, it has assured those who are mostly traders, to protect their business interest in the state. Perhaps, this has left the Igbos divided over which of the governorship candidate to support.
Ambode gets endorsement
Only recently, Igbo traditional rulers in Lagos, under the aegis of Eze Ndigbo in Lagos, endorsed noting that Ndigbo has enjoyed robust and cordial relationship with the APC administration since 1999.
At a briefing in Lagos, Eze Uchechukwu Nwachukwu said Ndigbo in Lagos will vote for Buhari and the Lagos State APC governorship candidate, Mr. Akinwunmi Ambode, on March 28 and April 11.
Reportedly, Nwachukwu said “after a strategic meeting of Ndigbo in Lagos, we have resolved to vote for the APC. Our interest in the state has been protected and we equally want to show appreciation by voting for the APC candidates. “I call on all our brothers and sisters to use their vote wisely, by this pronouncement we have endorsed Akinwunmi Ambode.”
Agbaje too
Similarly, an Igbo group, the Association of Ndi Eze Ndigbo in the Diaspora comprising all Ezes in the North, South West, South South and overseas in conjunction with the Lagos State chapter gave its backing to the candidature of Agbaje. In a press conference, Eze John Greg Uzobuadi, who is the association’s spokesman, said the Igbo supreme traditional head in the state, reaffirmed its support for Agbaje whom they described as friend of Ndigbo.
The association stated that it was no longer news that some Igbo chiefs (not traditional leaders) hosted the conference where they claimed to be the leaders of Igbo tradition in Lagos State.
While stating that the constitution of Nigeria guarantees the chiefs the right to free speech and association, it does not give them the right to misrepresent Ndigbo.
The race for Alausa House is reaching its crescendo, non-indigenes have a large population in the state that can decide who becomes the governor or any position.

Jonathan Assures On Soldiers Recapturing Old Territories

President Goodluck Jonathan has stated that it might take Nigerian soldiers “within a month” to recapture towns seized by Boko Haram insurgents in the northern part of the country.
The President made the statement in an interview the BBC aired on Friday, March 20, 2015, in which Mr President said that the Nigerian military hopes to recapture towns seized by Boko Haram within a month, in what would be a swift victory after six years of bloody conflict.
Speaking during the interview, Jonathan, who is seeking re-election on March 28, said Boko Haram was “getting weaker and weaker every day”.
“I’m very hopeful that it will not take us more than a month to recover old territories that hitherto have been in their hands,” he told the BBC.
Experts believe Jonathan’s statement might be because the Islamist militants have proved recently that they are still capable of carrying out deadly hit-and-run strikes.

Nigeria has recently recorded major victories against the insurgents with the help of coalition partners Cameroon, Chad and Niger.
The Nigerian military had during the week said that two out of three of the worst-hit northeast states, Yobe and Adamawa, have been declared “cleared” while the third, Borno, is expected to be liberated “soon”.
Major towns such as Bama and Dikwa are among some 36 localities recaptured, with just three said to be still in rebel hands.
Also, National security adviser, Mike Omeri, said on Wednesday that “the final onslaught” was under way.
More than 13,000 people have lost their lives in the conflict and the main opposition candidate, former military ruler Muhammadu Buhari, has campaigned hard on the government’s security record.

There have been fears about the safety of voters ahead of the forthcoming general elections across Nigeria after a spate of suicide attacks in the north in recent weeks and after Boko Haram leader Abubakar Shekau vowed to disrupt the election.

Meanwhile, the Nigeria Security Network of analysts on Thursday warned that Boko Haram would revert to its guerrilla campaign of bombings and suicide attacks in the face of military pressure.

A former deputy speaker of the Akwa Ibom state House of Assembly, Okon Uwah, was killed late in the evening on Thursday, March 19, by yet to be identified assailants at Nkek village in Ukanafun local government area of the state.

Okon Uwah, a  staunch member  of the opposition All Progressives Congress (APC) and a candidate for the Ukanafun state constituency in the forthcoming election,  was said to be on a house-to-house campaign tour of the area where he was  attacked.
His campaign train was said to have been ambushed by thugs who descended on him with several dangerous weapons, beat him unconscious and left him for dead.
After the attack he was said to have been rushed to a nearby hospital by members of his campaign team where he died.
The late former deputy speaker’s car was also not spared as it was damaged beyond repair by the hoodlums who swooped on him during the house-to-house campaign.
Described as a philanthropist, amiable and good natured, Uwah was reported to have died in the hospital as result of injuries he sustained during the attack.
Residents of the area reacted to news of the death with shock and disbelief, condemning the attack and calling for a full investigation.
Our correspondent learnt that top level policemen and a team of investigators have been dispatched to the area to forestall any breakdown of law and order.
Uwah’s body was taken to Uyo mortuary that same night.
Political violence has become an everyday issue as the general elections draw nearer.
Just a few days ago the convoy of Aisha Buhari, the wife of the All Progressives Congress’s presidential candidate, was attacked in Ilorin, Kwara state.

Buhari Should Beg Yoruba For Forgiveness, Not Votes — Fayose

The Ekiti State Governor, Ayodele Fayose, has said that the All Progressives Congress Presidential Candidate, Muhammadu Buhari, should seek forgiveness and not votes from the people of the Yoruba land and even those in Edo and Delta States.
“Buhari’s coup of 1983 destroyed the Southwest and the old Bendel State (now Edo and Delta) as it put an end to the developmental programmes of the late Chief Obafemi Awolowo’s Unity Party of Nigeria (UPN) government in the Southwest States of Lagos, Oyo, Ogun and Ondo, as well as Bendel State,” Mr. Fayose said.
Speaking through his Special Assistant on Public Communications and New Media, Lere Olayinka, Mr. Fayose said Mr. Buhari meted out inhuman treatment to Yoruba leaders like Obafemi Awolowo, Adekunle Ajasin, Bisi Onabanjo, Bola Ige, Lateef Jakande and the immediate past APC National Chairman, Bisi Akande, all of whom championed development and good governance in the Southwest States.
The governor described Mr. Buhari’s cancellation of the Lagos metro line project in 1985 as the greatest disservice to the Yoruba people in particular, and Nigerians in general.
“If Buhari had not cancelled the metro line project out of vendetta, transportation problems in Lagos would have been solved permanently.
“The metro line project would have made life easier and changed the face of transport in Lagos. But Buhari cancelled it and even went ahead to pay compensation to the French company that handled it. Buhari’s action cost Lagosians over $78 million then,” Mr. Fayose said.
Speaking further, the governor said; “In Yorubaland, we were enjoying free education and free health before Buhari came. Then, all that was needed to go to primary and secondary schools was school uniform. Drugs were free.
“Apart from free education and free health, the Southwest witnessed rapid development. Lagos State University, Ogun State University (now Olabisi Onabanjo University), Ondo State University (now Ekiti State University), Ondo State Polytechnic (now Rufus Giwa Polytechnic), and several other institutions were established.
“As at 1979, Lagos State had no secretariat. Jakande’s government built the Alausa Secretariat within four years. Ajasin’s government built Alagbaka Secretariat in Akure within four years. Even the Lekki-Epe road on which they are now collecting tolls was constructed by Jakande.
“For all that they did for us in Yorubaland, what did Buhari do to Jakande, Ajasin, Bola Ige and Bisi Onabanjo? He jailed them and Bisi Onabanjo came out of prison with health issues that eventually claimed his life.
“What did Buhari do to reward Awolowo, whose party gave us free education and free health? Awolowo’s international passport was seized and he was prevented from travelling abroad for medical treatment. Awolowo died two years after!
“In 1984 that Buhari introduced school fees, thousands of our youths then dropped out of school.
“Therefore, Buhari who truncated the future of many of our people and jailed our leaders who served our land selflessly should be seeking forgiveness from Yoruba people, not votes.”

DSS Blames Fear Of Election Violence For Fuel Shortage

The Department of State Services (DSS) has attributed the fuel queues across the country to the refusal by petrol tankers to load petroleum products to the North for fear of being caught in likely election violence as witnessed in 2011.
The service however assured members of the National Association of Road Transport Owners of security, noting that adequate arrangements have been made to guarantee their safety.
“Consequently, Brigade Commanders, Police Commissioners and State Directors of the DSS have been directed by the Chief of Army Staff, the Inspector-General of Police, and the Director-General, Department of State Services respectively, to provide adequate security,” the DSS spokesperson, Marilyn Ogar said in a statement on Thursday night.

Ogar said the government recognised the fact that NARTO and other unions provide essential services and as such, would do everything to protect them.
She reassured NARTO and all Nigerians of the security and safety of their lives and property.
The DSS boss explained that the Nigerian National Petroleum Corporation (NNPC) had assured the public that there was adequate petroleum products to meet demands before, during and after the elections and therefore urged the public not to resort to panic buying and hoarding.
The statement read, “This Service has observed lately the build-up of queues at petrol stations. Investigation has revealed that trucks that would hitherto have loaded products from the South for distribution in the North are reluctant to do so.
“This development is premised on fears by NARTO of being caught in likely election violence as was witnessed in 2011, which resulted in loss of lives and property.”
